Terms of Service

These Terms of Service ("Terms") govern the access to and use of Plan de Garde, accessible at plandegarde.lu, published by Ikimas.
1. Definitions
- Service: the Plan de Garde online platform, accessible at plandegarde.lu, enabling the management and organization of medical on-call schedules.
- Publisher: Ikimas. See our Legal Notice for full publisher details.
- User: any individual with an account on the Service.
- Administrator: the User designated to manage a team of doctors within the Service.
- Team: a group of doctors collaborating through the Service to organize their on-call schedules.
2. Purpose of the Service
Plan de Garde is an online on-call schedule management tool designed for independent medical practitioners in Luxembourg. The Service allows users to:
- View and organize on-call schedules within a team
- Visualize the distribution of on-call duties among team members
- Receive notifications related to on-call schedules
- Import official hospital rotation schedules published by the Luxembourg Ministry of Health to determine on-call patterns
The Service is a purely organizational tool. It does not process any health data or patient data.
3. Registration and Account
Access to the Service requires account creation. Administrator accounts are created and configured by the Publisher for each team. The Administrator is then responsible for adding doctors to their team.
Users agree to:
- Provide accurate and up-to-date information
- Maintain the confidentiality of their login credentials
- Immediately inform the Publisher of any unauthorized use of their account
The Publisher shall not be held responsible for any unauthorized access resulting from a failure to protect credentials by the User.
4. Billing
The Service is offered as a paid subscription. Billing frequency and pricing are agreed upon subscription and communicated to the Administrator. Invoicing and payment are handled outside the platform.
The Publisher reserves the right to modify pricing with at least 30 days' notice. In case of disagreement, the User may cancel before the effective date.
In the event of non-payment, the Publisher reserves the right to suspend access to the Service after a reminder has been sent without response.
5. Use of the Service
Users agree to use the Service in accordance with its intended purpose and these Terms. The following is prohibited:
- Using the Service for unlawful purposes
- Attempting to access data belonging to other teams
- Reproducing, copying, or reselling any part of the Service
- Introducing viruses or malicious software
- Automated data extraction (scraping)
- Intentionally overloading the Service infrastructure
6. Ministry of Health Schedule Data
The Service uses data from official hospital rotation schedules published by the Ministry of Health of the Grand Duchy of Luxembourg. Administrators upload these documents into the Service, which extracts the alternating on-call patterns to generate schedules. The Publisher does not guarantee the accuracy of the extracted data and shall not be held responsible for any errors in parsing or delays in updates from official sources.
It is the User's responsibility to verify schedule information with official sources.
7. Availability and Maintenance
The Publisher strives to maintain the Service accessible 24/7 but cannot guarantee permanent availability. The Service may be temporarily interrupted for maintenance, updates, or in cases of force majeure.
The Publisher shall not be held responsible for Service interruptions and their consequences.
8. Liability
8.1 Publisher's Liability
The Service is provided "as is". The Publisher commits to exercising reasonable care in providing the Service but shall not be held liable for:
- Errors, inaccuracies, or omissions in schedules
- Decisions made by Users based on information from the Service
- Indirect damages (loss of revenue, loss of data, moral prejudice)
- Interruptions or malfunctions related to the hosting provider or network
The Publisher's total liability is limited to the amounts actually paid by the User during the preceding 12 months.
8.2 User's Liability
The User is solely responsible for their use of the Service and for verifying on-call schedules. The Service is an organizational aid and does not replace the professional and regulatory obligations of medical practitioners.
9. Intellectual Property
All intellectual property rights are described in the Legal Notice.
Data entered by Users remains their property. The Publisher holds a limited usage license solely for the purpose of providing the Service.
10. Termination
10.1 By the User
The User or Administrator may request cancellation at any time by contacting the Publisher. Cancellation takes effect at the end of the current billing period.
10.2 By the Publisher
The Publisher may suspend or terminate an account in case of violation of these Terms, after notification by email. In case of serious breach, suspension may be immediate.
Upon termination, all associated data is deleted in accordance with the Privacy Policy.
11. Data Protection
The processing of personal data is described in the Privacy Policy, which forms an integral part of these Terms.
12. Modifications to the Terms
The Publisher reserves the right to modify these Terms. Users will be informed of any substantial changes by email or notification within the Service at least 15 days before taking effect. Continued use of the Service after modification constitutes acceptance of the updated Terms.
13. Applicable Law and Disputes
These Terms are governed by French law.
In the event of a dispute, the parties commit to seeking an amicable solution. Failing that, the dispute shall be brought before the competent courts, subject to applicable consumer protection rules within the European Union.
